Tire & Wheel World NV (“us”, “we”, or “our”) operates the https://bestelpiesa.com/ e-commerce platform (the “Products”).
Before placing an order on bestelpiesa.com, please make sure you read and understand your rights and obligations under these terms and conditions.
Your order is subject to these conditions which provide the terms and conditions for the Contract of Sale between you (the “Customer”) and Tire & Wheel World NV (“TWW”), the company operating the online sales website https://bestelpiesa.com/.

The sale of products described herein (the “Products”) is subject to these conditions and no other agreement shall be binding on TWW nor shall apply in any manner whatsoever to the sale of the Products. No change in these conditions shall be binding unless signed by an authorized officer of TWW.
B. The Products
B.1
All questions regarding the products must be submitted using the Parts inquiry form, the contact form, the email: info@bestelpiesa.com, or by phone 599-9 5154430.
B.2
Products offered for sale by TWW are intended for individuals and professionals.
B.3
TWW sells only new products. The features of Products presented on the BESTELPIESA site may be modified from time to time at the discretion of TWW.
The NAME, PICTURE, SKU and BRAND of each product is binding.
There may be products offered for sale on the BESTELPIESA site that has no pictures yet. In this case, the customer has the right to request the product’s image, or any other information regarding the product, that may be needed to the customer before placing an order.
B.4
The Customer is responsible for complying with requirements and recommendations for safety in use of (vehicles, parts, service tools, mounting procedures, technical data, adjustments, safety standards, cautions, warnings, etc.), in installation and in storage of the Products.
TWW will not be responsible in any way for installation or use of the Products under abnormal conditions.
C. Product availability
C.1
Products offered and corresponding prices are valid while stocks last. TWW shall use reasonable means to promptly post any price changes for Products on sale by making regular updates to its website.
C.2
If TWW is not able to deliver any Product ordered due to stock shortage, TWW will notify the Customer by email and may at that time offer the Customer to modify or cancel its order.
If modified, TWW will adjust the amount of the order accordingly and confirm the modified order to the Customer by email.
D. The Order
D.1
All orders and Parts Inquiries must be made online through the BESTELPIESA site, and all questions must be submitted using the Parts inquiry form, the contact form, the email: info@bestelpiesa.com, or by phone 599-9 5154430.
D.2
An Order Confirmation will be sent within 24 hours of order registration by automatic email to the email address provided by the Customer.
Orders will be processed only after receipt of customer payment by PayPal, Debit or Credit Card, bank transfer or deposit of payment into our Bank account, corresponding to the amount shown on the Bill.
Please use your Order ID as the payment reference. Your order will not be processed until the funds have cleared in our account.
Any order for which payment is not made within seven (7) days after receipt of the Order Confirmation by the Customer, will be automatically cancelled.
D.3
The Customer is responsible regarding the information provided while submitting the order, however, of course we (“TWW”) will conduct the final check to ensure the parts are compatible with your vehicle, prior placing the order to our suppliers.
The vehicle information provided by the customer is a mandatory requirement to ensure the parts will fit the vehicle.
TWW is not liable for incompatible parts ordered if the customer provides inaccurate vehicle information while submitting the order.
TWW does not accept any change of the vehicle information provided by the customer, namely: (VIN/CHASSIS, MAKE, MODEL, YEAR, ENGINE LITER), nor of the products (NAME, PICTURE, SKU and BRAND) or of the customer (FIRST NAME, LAST NAME, COUNTRY, STREET ADDRESS, TOWN, STATE, EMAIL ADDRESS) after the payment of the order.
D.4
In case of error in the Order submitted by the customer, the Customer must contact TWW Customer Service immediately through the contact form, or by the e-mail info@bestelpiesa.com, requesting the order amendment or its cancellation. This is only allowed prior the payment of the order.
D.5
TWW reserves the right to refuse any order for any reason whatsoever.
E. Price
E.1
The purchase price for each product ordered is the one shown on the Site.
The purchase price for each product inquired by the customer via the BESTELPIESA “Parts inquiry” form, will be sent to the customer through the e-mail info@bestelpiesa.com.
E.2
Prices displayed on the BESTELPIESA site are expressed in US dollars and includes all Curaçao import duties.
E.3
All shipping costs and sales tax (the “OB”) will be shown at the Cart page after adding the product to the Cart, and by entering the respective country in the “Calculate shipping” section.
Customers from other countries does not pay (the “OB”), but may be required to pay the respective import duties in their country.
E.4
TWW reserves the right to change the prices of Products offered on the Site at any time and without notice.
F. Payment
F.1
Payments can be made by PayPal, Debit or Credit Card. Payments by bank transfer (online banking) or deposits of payment into our bank account are accepted.
G. Delivery
G.1
TWW will deliver the Products ordered to the address provided at the time of the Customer’s order.
G.2
Products ordered by the Customer will be delivered within approximately 4-7, 21, 28 or 35 days by TWW, as selected and provided by the customer while submitting the order.
Consequently, non-respect of any delay provoked by the local customs and shipping forwarders shall under no circumstances give rise to damages for any reason whatsoever.
G.3
The Customer becomes the owner of the Products ordered upon delivery by TWW to the customer address, or when the products are handed over to the customer.
From this point, the Customer is bound to assume all risks and TWW is not responsible for their loss, damage or destruction.
G.4
No delivery will be made to a post office box.
G.5
The Customer is responsible to ensure that the Products delivered conform to the Order before the Products are installed on a vehicle.
Any claim relating to an incomplete or inaccurate shipment shall be made within seven (7) days following the date of receipt of the Products using the contact form.
H. Cancellation of the sale
H.1
The Customer may request return of the Products relating to an incomplete or inaccurate shipment at any time until the end of the 7th day following receipt of the products using the contact form, only if, TWW’s suppliers cannot complete the shipment, or does not have the correct product to fulfill the shipment in the same time frame as when they were ordered by the customer in the first place, and on condition that the Products have not been installed on a vehicle or used in any manner whatsoever. Products installed shall in no case be returned or refunded.
H.2
The Customer may not return the products to TWW himself. The return request shall be made exclusively on the contact form.
The Customer will then be contacted and given all instructions as for the return of the products.
H.3
Upon receipt of the returned Products, any amount paid by PayPal, Debit or Credit Card, bank transfer or deposit in favor of TWW regarding these Products, shall be credited to the customer as soon as possible but no later than 7 days, provided however that the Products being returned are received by TWW in the same condition in which they were when they were delivered.
I. Force majeure
I.1
For the purposes hereof, force majeure includes any Act of God, war, mobilization, government regulation, customs, strike, lockout, drought, flood, total or partial fire, obstruction of navigation, loss, damage or detention in transit, defective material or delays by shippers or other contingencies beyond the control of TWW which could prevent manufacture, shipping or delivery of the Products covered hereby. Performance of TWW’s obligations may be suspended in the event of force majeure without any responsibility incurred by TWW towards the Customer for any damage or loss arising from such delay.
J. Limited Warranty
J.1
Subject to the following, TWW guarantees that the Products sold hereby conform to the specifications and standards applicable to the industry and that title for the goods are free of any security, guarantee or mortgage. TWW shall ensure that the Customer is the beneficiary of manufacturer’s warranties and in no case shall the TWW warranty exceed that given by the Product’s manufacturers. TWW’s sole obligation under such a warranty shall be to replace the Products as the manufacturer deems necessary and to support the Customer for any claim to the manufacturer. The warranty above is the sole exclusive guarantee, express or implied, provided by the seller and supersedes all other guarantees of any nature whatsoever, contractual, legal, statutory or otherwise, for purposes of marketability, quality, compatibility or otherwise. Any claim to the manufacturer requested by the customer, must be reported to Tire & Wheel World NV in writing using the contact form, or by the e-mail info@bestelpiesa.com
K. Limitation of Liability
K.1
TWW’s liability shall under no circumstances exceed the purchase price of the Products supplied and in no case shall TWW be liable for any indirect, consequential, special, accessory or punitive damages or for loss of business of any nature whatsoever (including damages for loss of profits) allegedly suffered by the Customer.
L. Intellectual Property
L.1
Trademarks and logos used or displayed on the Site are trademarks and logos, whether registered or not, of TWW or third parties. Nothing on the Site may be construed to allow, directly or indirectly, the use of such trademarks or logos without prior written authorization from their owner. Without limiting the generality of the foregoing, it is prohibited to reproduce trademarks and logos found on the Site for any reason whatsoever.
L.2
All elements on the Site (including, without limitation, text, articles, photographs, images, illustrations, audio and video extracts, software, etc.) are protected by copyright and belong to TWW or to third parties acting as content providers. Unless clearly stated otherwise, no part of the Site may be construed as granting the Customer any right whatsoever with regards to intellectual property of TWW or a third party acting as a content provider.
L.3
The Customer may not copy, reproduce, modify, publish, distribute, participate in transfer or sale, create derivative works from, translate, download, license or exploit in any manner, any item offered on the Site (including any software), in whole or in part.
L.4
TWW is in no case responsible for the content or Products or services offered on sites to which the Site is linked by hypertext links or any other type of link. TWW has no control over these sites and accepts no liability for access, content or use of these sites, nor for damages that may result.
M. General provisions
M.1
The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement nor to any Order.
M.2
The Parties hereby accept that this Contract shall be interpreted and governed by the applicable laws of Willemstad Curaçao, without regard to the principles of conflict of laws. In addition, the parties choose to submit any dispute or any proceeding arising under this Contract to the exclusive jurisdiction of the Court of Willemstad, in the judicial district of Willemstad, without prejudice to the rights of venue to obtain any precautionary measure, such injunction to any court of competent jurisdiction.
M.3
TWW undertakes never to divulge personal information about its customers and not to use it for other purposes than to communicate with them and respond to orders. The Customer has the right of access at any time and may correct personal data concerning him/her.
M.4
Before submitting his/her Order, the Customer declares that he/she has read these general conditions and accepts them without reservation in their entirety.
M.5
Should any part hereof or any section, paragraph or sub-paragraph be declared invalid or unenforceable by any court having jurisdiction therein, the parties expressly agree that such a judgement shall not affect the validity of other provisions hereof, which retain their full and entire validity.
